StoreProtect – Contents Protection

Important information

StoreProtect is an optional contents protection arrangement available with your Lockit Local storage unit. Please read the information below carefully, as it explains what StoreProtect is, what it covers, what it does not cover, and your responsibilities.

StoreProtect applies automatically as part of your booking unless you actively opt out of “Goods Protection” during the booking process.

StoreProtect Addendum

Our Conditions of Agreement restrict liability to negligence only up to a maximum of £100 and require You to arrange insurance cover for the Maximum Replacement Value of Your Property. As an alternative, We can accept an enhanced liability for Loss or Damage which may occur during storage.

“StoreProtect” means an agreement to accept an enhanced liability for Loss or Damage to Your Property as described in this Addendum. “StoreProtect Charges” means the additional charges set out in the Self Storage Agreementfor StoreProtect.

Please take the time to read the detailed terms set out below. In particular, attention is drawn to the section titled Exclusions – what StoreProtect does not provide for, which includes circumstances where We limit or exclude Our liability to You.

StoreProtect is not a contract of insurance. We are not an insurance company, nor are We acting as Your agent. We are under no obligation to arrange an insurance policy in Your name. We assume the risk of liability but may, at Our option, arrange insurance which provides cover for Our liability to You in certain circumstances.

StoreProtect may not be available in certain circumstances and We reserve the right to decline at Our sole discretion where You have indicated that You wish to opt for StoreProtect.

Definitions

For the purposes of this Addendum, the following definitions shall apply.

“Property”, “Your Property” or “Goods” means any and all goods stored by You in a storage unit allocated to You at the Facility.

“Replacement Value” means the current cost of replacing Your Property as new, except that household linen and clothing, motorcars, motorbikes, boats, caravans, motorhomes and any other motorised vehicle shall be valued allowing for age, quality, degree of use, existing damage and consequent market value. Goods which cannot be purchased new, such as antiques or works of art, shall be valued at their current market value. Documents shall be valued as the physical cost of replacing

the documents and or the cost of reprinting, re issue and or reconstitution, excluding the value of the information contained in the documents.

“Maximum Replacement Value” means the maximum sum total of the Replacement Value for all Property at any time throughout the period of storage.

“Loss” or “Damage” means identifiable losses, destruction of or damage to Your Goods, wilful acts, omissions and default, including theft by forcible entry or damage caused by Us, Our employees, agents or representatives while the Goods are in the unit.

StoreProtect – What do I receive?

In return for payment of the StoreProtect Charges, We agree to accept an enhanced liability for Loss or Damage to Your Property and the limit of £100 in the event of negligence shown in the enclosed Conditions of Agreement will not apply.

Instead, We accept liability for Loss or Damage to Your Property following a breach of Our Duty of Care up to a maximum of either the Maximum Replacement Value or the actual value of Your Property affected by Loss or Damage, whichever is less, taking into account any Proportional Reduction and subject to the exclusions set out below

Our liability will commence from the time Your Property is placed by You into Your storage unit or units and will cease immediately upon removal of Your Property from those storage unit or units.

If You opt for StoreProtect, You are no longer obligated to arrange insurance for Your Property.

If You submit a claim, additional claims processing administration charges apply. We will deduct a £50 charge from any settlement awarded to You to cover Our administration costs, referred to as the Claims Admin Fee.

Our liability to You under StoreProtect for Loss or Damage to Your Property will be assessed as a sum equivalent to the cost of repair or cleaning, the Replacement Value, or compensation, whichever is the smaller sum, at Our option. We accept no liability for depreciation following repair.

Our Duty of Care under StoreProtect

We are responsible for maintaining the Facility in a secure condition and will provide Our services with reasonable skill and care.

Our liability in relation to the Goods under StoreProtect shall be that of a reasonably careful person under like circumstances. We shall not be liable for any Loss or Damage to the Goods while the Goods remain in the unit or under Our care, custody or control unless such Loss or Damage resulted from Our failure to exercise such care as a reasonably careful person would exercise under like circumstances. We will not be liable for damages which could not have been avoided by the exercise of such care.

Your Responsibility

To opt for StoreProtect, it is Your responsibility to provide a Maximum Replacement Value on the Customer Declaration, to sign the appropriate box on the Customer Declaration to confirm Your wish to opt for StoreProtect, to pay the additional charges set out for StoreProtect, and to ensure that the Maximum Replacement Value is accurate at all times for the duration of this Agreement.

Proportional Reduction

If the Maximum Replacement Value You provide is less than the actual total Replacement Value of all of Your Property stored in Your unit at the time of Loss or Damage, then Our liability will be reduced to reflect the proportion that Your Maximum Replacement Value bears to the actual total Replacement Value.

For example, if the total replacement value of Your Property is £10,000 but You have declared a Maximum Replacement Value of £5,000, Our liability will be reduced by 50 percent. If £3,000 worth of Your Property is lost or damaged, Our liability would be £1,500.

Exclusions – what StoreProtect does not provide for

StoreProtect cannot be accepted for any motorcar, motorbike, boat, caravan, motorhome or any other motorised vehicle and trailers stored outside of a unit, for any food or perishable Goods, or for any delivery and collection Goods.

Our liability for the Goods listed above is restricted and the requirement for You to insure Your Property remains valid in accordance with the Conditions of Agreement, whether or not You opt for StoreProtect for other stored Property.

Restricted Goods

Our liability for Loss or Damage to the following Goods is restricted. Goods worth in excess of the amounts stated should not be stored without Our express written permission.

Jewellery, watches, precious stones, precious metals and stamps of all kinds are restricted to a combined total of £1,000.

Furs, fine art, perfumery, tobacco, cigars, cigarettes, beers, wines, spirits and the like are restricted to a combined total of £15,000.

Electronic Items are restricted to a combined total of £25,000. Electronic Items include all consumer and commercial electrical appliances and instruments, including televisions, computers, laptops, tablets, mobile phones, cameras, hi fis and stereos. Heavy electrical items such as switchgear, turbines and generators are not deemed to be electronics.

Excluded Liabilities

We shall not be considered to be in breach of this Agreement and exclude all liability to You in respect of mysterious disappearance or unexplained shortage of Your Property, except where theft is evidenced by forcible entry to Your Unit.

We exclude liability for Loss or Damage discovered after Your Property is removed from the Facility.

We exclude liability for Loss or Damage to Your business, including indirect or consequential loss, lost profits, income or savings, wasted expenditure or business interruption.

We exclude liability for Loss or Damage caused by moth, insect or vermin unless from a source external to Your Unit; ordinary leakage; ordinary loss in weight or volume; evaporation; the nature of the property stored; leakage of liquid from any container unless from a source external to Your Unit; inherent vice or latent defect; mould, mildew or rust unless proven to result from water ingress from a source external to Your Unit; atmospheric or climatic causes; or Loss or Damage to Property unsuitable for storage.

We exclude liability for electrical, electronic or mechanical derangement, or any loss or damage resulting from software or microchip failure, except where this results directly from external physical damage caused by a breach of Our duty of care.

We exclude liability for any value arising because an item forms part of a pair or set, for purely sentimental value, for Loss or Damage caused by non-compliance with laws or regulations by You or Your Agents, and for Loss or Damage caused by the act or omission of You or Your Agents, including failure to secure the Unit, improper packing or stacking, the manner of storage, conduct at the Facility, or loading and unloading of Goods.

General Exclusions and Limitations

We exclude and limit certain types of Loss or Damage as set out in the Conditions of Agreement, and these exclusions apply whether or not You opt for StoreProtect.

Where Goods are stored in breach of this Agreement, You bear the risk of any Loss or Damage to such Goods.

We will not be liable for any Loss or Damage unless You notify Us in accordance with the Liability Claim Notification requirements.

Maximum Liability

We will have no liability under any circumstances for Loss or Damage to Your Property over and above the Maximum Replacement Value or the actual value of Your Property lost or damaged, if this is less.

Why We Restrict Liability

It is not always clear how Loss or Damage was caused, and We must limit or exclude liability in certain circumstances. We cannot accept liability for Loss or Damage which could not have been reasonably avoided.

StoreProtect is not a contract of insurance, and You may arrange Your own insurance separately.

Our Agreement

Our standard Conditions of Agreement apply in full. If You opt for StoreProtect, the £100 liability limit is replaced by the Maximum Replacement Value (subject to Proportional Reduction), and the requirement to insure Your Property becomes optional rather than mandatory.

Failure to Pay StoreProtect Charges

If You fail to pay StoreProtect Charges in full on the due date, You will not benefit from the enhanced liability offered under StoreProtect. Our liability will be restricted to negligence only up to £100, and You will be required to insure Your Property.

At Our sole discretion, We may reinstate StoreProtect upon payment of outstanding charges, unless Loss or Damage has already occurred.

Termination and Cancellation

You may cancel StoreProtect at any time before removal of Your Property by giving written notice. If cancelled before storage commences, all StoreProtect Charges will be refunded. If cancelled after storage has started, charges paid in advance for the period after cancellation will be refunded.

Your right to benefit from StoreProtect will terminate automatically if payments are not made when due. We may cancel StoreProtect at any time by giving thirty days’ written notice. Any charges paid in advance for the period after cancellation will be refunded.

After cancellation, Our liability will be restricted to negligence only up to £100 and You will be required to insure Your Property. If You terminate the storage agreement after cancellation, the notice provisions in the Conditions of Agreement will apply.

General FAQs

What is StoreProtect?

StoreProtect is an extension to our standard contract that allows us to accept liability for loss or damage to your Goods in certain circumstances. Our liability under StoreProtect is accepted on a new replacement basis for most Goods you store.

However, there are restrictions for some items, such as jewellery, watches, furs, fine art, beers, wines, and electrical items. We cannot offer StoreProtect for motorcars stored outside a Unit or for food or perishable Goods.

To benefit from StoreProtect, you must declare an appropriate new replacement value for all Goods stored (known as the Maximum Replacement Value). This figure must be adequate to include all Goods at all times.

If you do not opt for StoreProtect, our standard terms limit our liability for your Goods to a maximum of £100. You are also required to arrange insurance at your own expense for your stated Maximum Reinstatement Value for the duration of storage.

Do I have to insure my Goods?

Our Self Storage Agreement requires you to either accept our enhanced liability protection under StoreProtect, or arrange insurance at your own expense for your stated Maximum Reinstatement Value for the duration of storage.

How do I calculate my Maximum Replacement Value?

We must understand the total value of all Goods stored with us, even if you arrange insurance elsewhere. It is therefore a requirement for all customers to declare a suitable Maximum Replacement Value and ensure it remains adequate for the storage period.

Your Maximum Replacement Value must represent the total current cost of replacing all stored Property as new, except for the following items where the replacement cost is calculated differently:

  • Household linen and clothing, motorcars, motorbikes, boats, caravans, motorhomes and any other motorised vehicles, where the Replacement Value allows for age, quality, degree of use, existing damage and consequent market value.
  • Goods which cannot be purchased new (such as antiques or works of art), where the Replacement Value is the current market value.
  • Documents, where the Replacement Value is limited to the physical cost of replacing the documents and/or the cost of reprinting, re-issue or reconstitution, excluding the value of the information contained within them.

If you opt for StoreProtect:

If the Maximum Replacement Value you provide is less than the actual total Replacement Value of all Property stored at the time of loss or damage, our liability will be reduced proportionally to reflect the relationship between the declared Maximum Replacement Value and the actual total Replacement Value ("Proportional Reduction").

For example, if the total replacement value of your Property is £10,000 but you declared a Maximum Replacement Value of £5,000, our liability would be reduced by 50%. If £3,000 worth of Property is lost or damaged, our liability would be £1,500.

Is there anything I can’t store?

There are certain items which are not suitable for storage. Please also refer to condition 6.3 of our Self Storage Agreement.

You must not store (or allow any other person to store) any of the following in the Unit:

  • Food or perishable Goods unless securely packed in hard plastic or glass containers so they do not attract vermin.
  • Any living creatures.
  • E-scooters, E-bikes, E-skateboards or any battery-powered vehicles of a similar kind.
  • Combustible or flammable substances such as gas, paint, petrol, oil, cleaning solvents or compressed gases.
  • Firearms, explosives, weapons or ammunition.
  • Chemicals, radioactive materials, biological agents, toxic waste, asbestos or other hazardous substances.
  • Any Goods that emit fumes or odours.
  • Illegal Goods or substances, including counterfeit or smuggled items and unlicensed or unsafe Goods.
  • Goods that are environmentally harmful or pose a risk to the Property of any person.
  • Currency, deeds and securities.
  • Property where the value cannot be assessed on a financial basis, including purely sentimental items.
  • Any Goods contaminated with food or other substances which may deteriorate, rot, become mouldy or attract vermin.
